Applicability
These general terms and conditions apply to all trips, tours, day trips, and other services organized or mediated by Jungle Jive Travel N.V..
By booking a trip or service with Jungle Jive Travel N.V., the traveler declares to have read these terms and conditions and to agree to them.
1. Introduction
1.1. Jungle Jive Travel N.V. is a Suriname-based travel company specializing in tailor-made journeys through Suriname, Aruba and Curaçao.
1.2. These terms and conditions apply to all travelers who book a trip or service with Jungle Jive Travel N.V., including all travel companions and minors included in the booking.
2. Formation of the Agreement
2.1. The travel agreement between the traveler and Jungle Jive Travel N.V. is established once the traveler accepts the offer of Jungle Jive Travel N.V. in writing or electronically. After acceptance, the traveler will receive a written or electronic booking confirmation, including the invoice and agreed conditions, as soon as possible.
2.2. For bookings made via the internet or other digital channels, the traveler will be clearly informed in advance that the booking becomes binding when the process is completed. From the moment Jungle Jive Travel N.V. confirms the booking, the traveler is bound by the agreement.
2.3. Jungle Jive Travel N.V. may cancel a trip if the minimum number of participants is not reached; any amounts already paid to Jungle Jive Travel N.V. will be refunded in full. Jungle Jive Travel N.V. cannot be held liable for any third-party costs incurred by the traveler, such as international flight tickets.
2.4. Jungle Jive Travel N.V. reserves the right to correct manifest errors or omissions in pricing or trip descriptions prior to the final confirmation.
3. Information Provided by Jungle Jive Travel N.V.
3.1. Jungle Jive Travel N.V. provides all relevant information about the trip at the time of the quote or booking, including prices, travel times, transportation, accommodation and activities.
3.2. We advise travelers on visa and entry requirements, vaccinations and health-related information, but the traveler remains solely responsible for compliance.
3.3. Exchange Rates and Price Adjustments
Prices are based on the applicable USD–EUR exchange rate at the time the offer is issued. Some components of the trip (such as accommodations, domestic flights or tours) are charged to Jungle Jive Travel N.V. in USD by suppliers.
If significant exchange rate changes occur before full payment is received, Jungle Jive Travel N.V. reserves the right to adjust the total travel price.
Any price adjustments will always be communicated to the traveler in advance.
4. Information Provided by the Traveler
4.1. The traveler must provide all required information in a timely manner, including:
✓ Personal details (name, date of birth, gender, contact information)
✓ Travel companions and composition of the travel group
✓ Medical information and dietary requirements, if relevant
✓ Passport details if required for domestic flights, entry requirements, or specific nature resort permits
4.2. Incomplete or incorrect information may result in exclusion from participation or additional costs for the traveler.
4.3. Minors may only book with permission from their parent(s) or guardian(s).
4.4. The traveler is responsible for obtaining additional information from the relevant authorities regarding passports, visa requirements, and health-related formalities (including vaccinations), and must verify well in advance of departure whether any previously obtained information has since changed.
5. Changes Made by Jungle Jive Travel N.V.
5.1. Changes to the itinerary may occur due to significant circumstances (such as weather conditions, safety concerns or government measures).
5.2. In the event of substantial changes, the traveler will be informed as soon as possible and provided with an alternative offer if possible.
5.3. If the traveler rejects this offer, they will receive a proportional refund of the travel sum for the unused part of the trip.
6. Force Majeure
6.1. Jungle Jive Travel N.V. is not liable for any shortcomings in the execution of the trip resulting from force majeure. Force majeure includes all circumstances that could not reasonably have been foreseen or prevented and lie beyond the control of Jungle Jive Travel N.V., including but not limited to:
✓ Natural disasters, extreme weather conditions, floods, earthquakes, storms, hurricanes
✓ War, terrorism, political unrest
✓ Strikes or labor disputes involving third parties or transport providers
✓ Government measures, restrictions, closures or regulations issued by local authorities
✓ Epidemics or pandemics
✓ Unexpected operational failures by third parties (e.g., airlines, hotels, transport companies)
6.2. In the event of force majeure, Jungle Jive Travel N.V. will make every effort to inform the traveler promptly and provide alternative solutions. If execution becomes impossible, the agreement may be terminated without Jungle Jive Travel N.V. being obliged to pay damages.
6.3. Suspension and Alternative Solutions
If circumstances of force majeure arise, Jungle Jive Travel N.V. may, at its own discretion, suspend, postpone or adjust the trip. Jungle Jive Travel N.V. may offer alternative solutions such as a modified itinerary or a different travel date.
In such cases, the traveler is not entitled to compensation for any missed components of the trip. Jungle Jive Travel N.V. will make reasonable efforts to offer suitable alternatives.
7. Cancellation by the Traveler
7.1. Travelers may cancel the travel agreement. Cancellations must always be reported in writing to Jungle Jive Travel N.V. Upon cancellation, the following percentages of the total travel sum shall apply. These cancellation fees are immediately due and payable upon cancellation:
✓ In case of cancellation up to the 60th calendar day (exclusive) prior to the departure date: 25% of the travel sum
✓ In case of cancellation from the 60th calendar day (inclusive) up to and including the 30th calendar day prior to the departure date: 45% of the travel sum
✓ In case of cancellation from the 29th calendar day (inclusive) up to and including the 15th calendar day prior to the departure date: 75% of the travel sum
✓ In case of cancellation from the 14th calendar day (inclusive) up to and including the 8th calendar day prior to the departure date: 95% of the travel sum
✓ In case of cancellation from the 7th calendar day (inclusive) prior to the departure date up to the day of departure or during the trip: 100% of the travel sum
7.2. For domestic flight tickets already booked and paid for, cancellation costs are always 100%, regardless of the time of cancellation as referred to in Article 7.1.
7.3. Jungle Jive Travel N.V. reserves the right to apply deviating (stricter) cancellation percentages or conditions in the event of special offers, specific local operators with deviating conditions, or complex tailor-made trips. These deviating conditions will be communicated to the traveler in writing prior to or at the time of booking.
7.4. Changes to the departure date or a reduction in the number of travelers are considered (partial) cancellations. An appropriate alternative will be proposed for the remaining traveler(s).
7.5. If the proposed change cannot be implemented or is not accepted, the original travel agreement will be fully canceled, and all involved travelers will owe the applicable cancellation fees.
7.6. The total sum of cancellation fees and adjusted travel sums will never exceed the original full travel sum. Any remaining amount will be offset against the new travel sums.
7.7. Cancellations submitted outside office hours will be handled as if received on the next business day.
7.8. If the actual financial loss demonstrated to be incurred by Jungle Jive Travel N.V. is lower than the flat-rate cancellation fees listed above, Jungle Jive Travel N.V. may, at its sole discretion, charge the lower amount. The traveler cannot derive any rights from this.
8. Payment
8.1. The full travel sum, including any deposits, must be paid within the deadlines stated on the invoice. The traveler is required to make payments on time according to the dates and amounts listed for deposits and final payments.
8.2. Payments may be made by (international) bank transfer or other agreed-upon payment methods. Any bank fees for international transfers are borne by the traveler.
8.3. In case of late payment, Jungle Jive Travel N.V. may cancel the booking and charge cancellation fees.
8.4. Currency, International Payments and Bank Charges
8.4.1. Jungle Jive Travel N.V. invoices in EURO. The currency stated on the invoice is binding.
8.4.2. All additional bank charges, transaction fees and currency conversion costs associated with international transfers are the responsibility of the traveler.
8.4.3. A payment is considered completed only when the full invoiced amount has been received net into Jungle Jive Travel N.V. ’s bank account.
8.4.4. Any exchange rate differences arising between the moment of payment, cancellation or refund are borne by the traveler.
8.4.5. Refunds are issued only in the same currency as indicated on the original invoice.
9. Liability
9.1. General Liability
Jungle Jive Travel N.V. is liable only for damage that results directly from shortcomings attributable to Jungle Jive Travel N.V. This includes damage arising from failure to properly execute the travel agreement or other breaches for which Jungle Jive Travel N.V. can be held responsible.
9.2. Limitation of Liability
If Jungle Jive Travel N.V. is liable for loss of enjoyment, financial loss or other indirect damages, the maximum compensation shall be limited to the amount of the travel sum for the services provided by Jungle Jive Travel N.V. Costs such as airline tickets, taxes, surcharges, additional transportation or other personal expenses are excluded.
9.3. Exclusions of Liability
Jungle Jive Travel N.V. is not liable for:
✓ Damage caused by intent or gross negligence of third parties or circumstances beyond its control
✓ Damage due to force majeure, natural disasters, extreme weather, political unrest, strikes, limited transport or communication facilities, limited medical assistance or the adventurous nature of the trip
✓ Damage resulting from death or injury unless caused directly and solely by the wilful misconduct of Jungle Jive Travel N.V.
✓ Loss, theft, damage, water damage or malfunction of personal belongings
✓ Damage resulting from the traveler’s failure to comply with vaccination, visa, entry or other health or safety requirements
9.4. Safety Instructions and Compliance
Travelers who do not comply with safety instructions, rules of Jungle Jive Travel N.V. or other obligations agreed in the travel agreement are not entitled to compensation or reimbursement of missed travel enjoyment.
9.5. Third Parties and Mediation
For components of the trip performed by third parties on behalf of Jungle Jive Travel N.V.—such as local tours, transportation, guides or excursions—Jungle Jive Travel N.V. acts solely as an intermediary. Travelers may submit claims or complaints in writing to Jungle Jive Travel N.V., who will forward them to the responsible provider and mediate between the traveler and the third party. Jungle Jive Travel N.V. ensures that complaints are handled with care and in consultation with the relevant party, but acts only as an intermediary and not as the responsible operator. Jungle Jive Travel N.V. is not liable for shortcomings or damages caused by third parties and is not required to compensate such damages.
9.6. Insurance
Travelers are advised to take out appropriate travel, cancellation and medical insurance to cover risks not borne by Jungle Jive Travel N.V.
10. Traveler Obligations
10.1. Travelers must follow the instructions of Jungle Jive Travel N.V. and/or its local partners to ensure the proper execution of the trip. They are liable for any damage resulting from their own actions or negligence, judged according to the standard of a careful traveler.
10.2. If a traveler causes such nuisance, danger or disturbance that the normal execution of the trip is hindered, Jungle Jive Travel N.V. may exclude the traveler from continuing the trip, as far as can reasonably be required. All resulting costs or losses are borne by the traveler, unless the cause cannot be attributed to them.
10.3. Travelers must prevent damage or, where this is not possible, limit it as much as possible, including complying with reporting obligations and safety instructions.
11. Complaints
11.1. Any problems or shortcomings during the trip must be reported immediately to the local service provider. If this is not possible, the traveler must contact Jungle Jive Travel N.V. directly.
11.2. If the issue cannot be resolved on-site, the complaint must be submitted in writing to Jungle Jive Travel N.V. within one month after completion of the trip or service, including a copy of the service provider’s report if available.
11.3. Complaints regarding the agreement or the booking process must be submitted in writing to Jungle Jive Travel N.V. within one month of becoming aware of the matter. Complaints submitted after this deadline may be disregarded unless the traveler cannot reasonably be blamed.
11.4. Jungle Jive Travel N.V. will provide the traveler with a substantive response no later than one month after receiving the complaint.
12. Privacy
12.1. Jungle Jive Travel N.V. processes personal data in accordance with applicable Surinamese legislation and the principles of the GDPR.
12.2. Personal data is used solely for the execution of the trip and communication regarding the booking.
12.3. Data may be shared with service providers when necessary for the execution of the trip.
13. Other Provisions
13.1. Jungle Jive Travel N.V. expects each traveler to treat the nature, culture and local communities visited during the trip with respect and care. Responsible and mindful travel contributes to a positive experience for both the traveler and the environment.
13.2. Surinamese law applies to these terms and to all agreements between Jungle Jive Travel N.V. and the traveler.
13.3. Any disputes arising from these terms will be submitted to the competent court in Paramaribo, Suriname.
